These Terms of Use ("Terms") govern your use of the Splitwise platform, including our website, mobile applications, AI services, and any related services (collectively, the "Services"). These Terms form a binding contractual agreement between you, the user of the Services, and Legal Check Pty Ltd (ACN 633 148 955) which operates the technology platform.
Important: Splitwise is an AI-powered platform designed to assist with family law matters. The Services use artificial intelligence which has inherent limitations and risks. By using our Services, you acknowledge that you use AI-generated content at your own risk.
For that reason these Terms are important and you should ensure that you read them carefully and contact us with any questions before you use the Services. You can contact us at help@splitwise.com.au.
By using the Services you acknowledge and agree that you have had sufficient chance to read and understand the Terms and you agree to be bound by them. If you do not agree to the Terms, please do not use the Services.
1. Service Description
Splitwise is an AI-powered platform that provides information, document generation, and guidance related to family law matters in Australia. Legal Check Pty Ltd operates the technology platform, while MKI Legal Pty Ltd is a law firm that may provide legal services to users when appropriate.
The Services are not a substitute for legal advice.No lawyer-client relationship is created through your use of the platform alone. The AI-generated content is for informational purposes only and should not be relied upon as legal advice for your specific situation.
2. AI Services - Important Warnings
You use our AI Services at your own risk. By using our Services, you acknowledge and accept that:
- AI-generated content may contain errors, inaccuracies, or inappropriate suggestions
- AI cannot replace the judgment and expertise of qualified legal professionals
- AI outputs are based on general information and may not apply to your specific circumstances
- You are responsible for reviewing and verifying all AI-generated content before use
- We do not guarantee the accuracy, completeness, or legal validity of any AI output
- AI may occasionally generate false information or "hallucinate" facts that do not exist
You must not rely solely on AI-generated content for making legal decisions. Always seek independent legal advice from a qualified lawyer before taking any legal action or making decisions that may affect your legal rights.
3. Licence to Use Services
We grant you a non-exclusive, non-transferable, revocable licence to use the Services in accordance with these Terms.
You may access and use the Services for your personal, non-commercial family law matters only. You may download or print AI-generated content for your own use in connection with your family law matter.
You must not:
- Use the Services for any unlawful purpose or in any way that could damage our reputation
- Attempt to reverse engineer, decompile, or discover the source code of our AI systems
- Use automated means to access the Services or collect data without our permission
- Share your account credentials with others
- Use the Services to provide legal services to others unless you are a qualified legal practitioner
4. Your Content
By submitting any content to our Services (including documents, questions, information about your situation, and any other inputs), you grant us a perpetual, irrevocable, worldwide, royalty-free licence to:
- Use your content to provide the Services to you
- Use your content to modify, improve, and enhance artificial intelligence models, and Services
- Create anonymised or aggregated datasets from your content
- Analyse usage patterns to improve our Services
You represent and warrant that you have all necessary rights to grant this licence and that your content does not infringe any third party rights.
We care about the integrity and security of your personal information. However, we cannot guarantee that unauthorised third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk.
5. User Responsibilities
You acknowledge and agree that:
- You must be at least 18 years old to use the Services
- You are responsible for the accuracy and completeness of all information you provide
- Providing false or misleading information may result in incorrect or harmful AI outputs
- You must review and verify all AI-generated content before using it
- You are solely responsible for any decisions or actions you take based on the Services
- You must maintain the confidentiality of your account credentials
6. Prohibited Uses
You must not use the Services to:
- Provide false or misleading information
- Impersonate another person or misrepresent your identity
- Attempt to manipulate, trick, or "jailbreak" the AI
- Generate content intended to harm, harass, or defame others
- Violate any laws or regulations
- Infringe intellectual property rights
- Upload malicious code or viruses
- Use the Services in any way that could damage, disable, or impair our systems
- Extract or scrape data from the Services without permission
- Create multiple accounts to circumvent restrictions
7. Intellectual Property Rights
We retain all intellectual property rights in the Services, including our AI models, software, designs, and content. Nothing in these Terms transfers any of our intellectual property rights to you.
AI-Generated Content: Subject to our rights and the rights of third parties, you may use AI-generated content produced specifically for you through the Services for your personal family law matter. However, we retain the right to use such content as described in Section 4.
You acknowledge that AI-generated content may be similar or identical to content generated for other users with similar queries or situations.
8. Privacy and Data Protection
Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
9. No Legal Advice or Lawyer-Client Relationship
The Services do not provide legal advice. Unless you specifically engage MKI Legal Pty Ltd or another law firm for legal representation through a separate engagement:
- No lawyer-client relationship exists between you and us
- No information you provide is protected by legal professional privilege
- The Services are not a substitute for legal advice from a qualified legal practitioner
- We are not responsible for any outcomes resulting from your use of the Services
We strongly recommend that you obtain independent legal advice from a qualified legal practitioner before making any decisions that may affect your legal rights or obligations.
10. Disclaimers and Limitation of Liability
To the full extent permitted by law, we exclude all liability in respect of loss of data, interruption of business or any consequential or incidental damages.
To the full extent permitted by law, we exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these Terms.
We make no representation or warranty:
- as to the accuracy, reliability or completeness of any AI-generated content or outputs;
- that the Services will be uninterrupted, error-free or free from viruses or defects;
- that AI-generated content will be suitable for your particular circumstances or requirements;
- as to the outcomes of any matter where you rely on the Services.
These Terms are to be read subject to any legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, conditions, guarantees or obligations. If such legislation applies, to the extent possible, we limit our liability in respect of any claim to, at our option:
- in the case of services: the supply of the services again; or the payment of the cost of having the services supplied again.
11. Indemnification
You agree to indemnify and hold harmless Legal Check Pty Ltd, MKI Legal Pty Ltd, and their officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Services
- Your breach of these Terms
- Your violation of any laws or third-party rights
- Any content you submit to the Services
- Your use of AI-generated content
12. Account Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we reasonably believe you have breached these Terms.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Services ceases immediately, but provisions of these Terms that by their nature should survive will continue to apply.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or through the Services. Your continued use of the Services after changes constitutes acceptance of the modified Terms.
14. General Provisions
You must not assign or transfer any of your rights under these Terms without our written consent.
If any provision of these Terms is invalid or unenforceable, it will be read down or severed to the extent necessary without affecting the remaining provisions.
These Terms are governed by the laws of Western Australia, and you submit to the exclusive jurisdiction of the courts of Western Australia.
No waiver of any provision of these Terms will be effective unless in writing and signed by us.
These Terms constitute the entire agreement between you and us regarding the Services and supersede all prior agreements and understandings.
